Horst Legal Counsel, PC (“Horst Counsel,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you visit horstcounsel.com (the “Site”), contact us, or use our services. This Policy does not diminish our professional duties of confidentiality or the attorney–client privilege.

1) Information We Collect

Identifiers & Contact Information: name, email, phone, organization/employer, and any details you submit via forms, email, or phone.

Prospective Client / Matter Information: facts you provide when you inquire about legal services (handled consistent with our ethical duties and, where applicable, attorney–client privilege).

Internet/Technical Data: IP address, device/browser type, pages viewed, timestamps, referring/exit pages, and approximate location (derived from IP).

Cookies & Similar Technologies: see Section 8.

Job Applicant Data (if applicable): résumé/CV and related information.

Important: We do not intend to collect sensitive personal information via the Site (e.g., health, financial account numbers, SSNs). Because we are a law firm, prospective clients might share such information. If you choose to send sensitive details before we confirm representation, do so only if necessary and avoid including confidential details through the general contact form.


2) How We Use Information

  • Operate, maintain, and improve the Site
  • Respond to inquiries, schedule consultations, and conduct conflict checks
  • Perform client intake and manage matters (including via Clio Grow)
  • Provide, secure, and debug our systems
  • Comply with legal, ethical, and accounting obligations
  • Send newsletters or legal updates you choose to receive (you may unsubscribe anytime)

We do not use attorney–client information for advertising.


3) How We Share Information

We may share information with:

  • Service Providers/Processors that support our Site and practice (e.g., hosting, email, IT/security, analytics, advertising platforms, and Clio Grow for intake). They are contractually limited to using information only to provide services to us.
  • Authorities and Professional Obligations when required by law, court order, or to protect rights, safety, and security.
  • Business Transfers in connection with a merger, reorganization, or similar transaction.

We do not sell personal information for money. We may “share” personal information (as defined under California law) for cross-context behavioral advertising when we use Google Ads. You can opt out—see Section 6 and Section 8.


4) Data Retention

We retain personal information only as long as needed for the purposes described, including to meet legal, ethical, and accounting obligations, and under our records retention policies. Client/matter records are retained consistent with professional rules.


5) Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information (e.g., HTTPS, access controls, updates/patching, MFA for admin accounts, and vendor agreements). No system is 100% secure. Please use caution when transmitting information online.


6) Your Privacy Rights (California)

California residents may have the right to know, access, correct, and delete personal information; to opt out of “sale” or “sharing” for cross-context behavioral advertising; to limit the use/disclosure of sensitive personal information; and to be free from discrimination for exercising these rights.

We do not sell personal information.

Sharing for advertising: We may share identifiers and internet activity with Google Ads for cross-context behavioral advertising. You may opt out at any time via our “Do Not Sell or Share My Personal Information” link (see Section 8).

We will verify your request (which may include confirming control of your email/phone or asking for limited information we already maintain) and respond within the timelines required by law. You may use an authorized agent with proof of authorization and identity.


7) Children’s Privacy

The Site is not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child has provided us information, contact us to delete it.


8) Cookies, Analytics & Advertising

What we use

  • Essential Cookies: required for core Site functions.
  • Analytics: We use Google Analytics to understand Site usage (pages visited, time on page, general location derived from IP).
  • Advertising: We use Google Ads (including remarketing) to reach audiences interested in our services.

Your choices

  • Cookie Banner / Settings: If non-essential cookies are present, you can manage them through our Cookie Settings link/badge (when deployed).
  • Opt-Out of Sharing (CPRA): Use our “Do Not Sell or Share My Personal Information” link (when deployed) to opt out of cross-context behavioral advertising.

  • Browser/Platform Controls: You can block or delete cookies in your browser and adjust Google ad settings (e.g., Ads Settings) and analytics opt-outs (e.g., Google’s opt-out add-on).

Note: Disabling non-essential cookies may affect some Site features. Essential cookies cannot be disabled via the banner.


9) Third-Party Links

The Site may link to third-party websites or services we do not control. Their practices are governed by their own policies.


10) Attorney–Client Relationship

Contacting us does not create an attorney–client relationship. Do not send confidential information until we confirm representation in writing. Information provided for potential representation is handled consistent with our professional responsibilities.
